Update 7/1/26: Attorney General Andrea Joy Campbell today reminded Massachusetts employers that Temporary Protected Status (TPS) designations for Haiti and Syria and related employment authorizations remain in place.

The Supreme Court’s opinion alone does not require immediate changes by employers. Employers may continue to rely on existing TPS-related work authorization and should await certified judgment and federal implementation guidance before making any employment decisions affecting TPS holders.

The US Supreme Court today issued a 6–3 decision allowing the federal government to move forward with terminating Temporary Protected Status (TPS) for Haiti and Syria, overturning prior lower court injunctions. The Court concluded that the TPS statute largely limits judicial review of these determinations, reinforcing executive authority over program designations and terminations — a ruling that is likely to have implications for TPS holders from other designated countries as well.

This ruling affects more than 350,000 Haitian and approximately 6,000 Syrian beneficiaries currently authorized to work in the United States. Employers should anticipate potential workforce eligibility changes and expect further guidance in coming days from the Department of Homeland Security (DHS) or the United States Customs and Immigration Services (USCIS) regarding TPS termination, status of employment authorization, and other employer obligations.
